(Abatti taking the IID back to court)….The litigation filed by Mike Abatti is to be heard Thursday.
Abatti has filed a contempt action against the Imperial Irrigation District, contending the District violated a previous court order concerning water deliveries. The litigation claims the district violated the previous order from Judge Anderholt when, in November, the board approved amendment to the water delivery contract with the Heber geothermal project. The amendment increases the amount of water to be delivered. The litigation contends the amended agreement does not include any action in case of a water shortage, and therefore establishes a priority to water in favor of a non-agricultural, non-domestic user. The action is scheduled to be heard by Superior Court Judge Anderholt.
